Complaint
On 10 April 2015, the EIB Complaints Mechanism (EIB-CM) received a complaint concerning the project Medio Ambiente Water Infrastructure in Spain and, in particular, the possible construction of a dam in Aguaviva on the river Bergantes (Spain) submitted for co-financing to the EIB. The complainant took the view that environment-related provisions of various European Directives such as 92/43/CEE, 2000/60/CE, 2009/147/CE and 97/11/CE had not been fully respected, and the provisions of the European Water Framework Directive 2000/60/CE on public information and consultation had been violated.
EIB-CM Action
Following a preliminary review of the case, the EIB-CM has taken note that the EIB operational team has not yet finalised the due diligence of the project and that the EIB Management Committee has not yet taken a decision to finance it. In this context, the complaint has been transferred to the Bank’s operational services.
Conclusions
The EIB operational services responded to the complainant to inform him/her that the dam was not part of the Medio Ambiente Water Infrastructure project or any other EIB operation.
