Complaint
On 22 February 2010, the EIB Complaints Mechanism (EIB-CM) received a complaint alleging the deficiency of the data used for the preparation of the Environmental Impact Assessment for the M11 Gorey to Enniscorthy road in Ireland.
The project comprises the construction of 16.5km of the N11 between Arklow and Rathnew, construction of the N7 Newlands Cross Junction Upgrade, construction of the Gorey services area and maintenance of a 30km section of the existing M11 that forms part of the Trans European Network under Transport 21 and the N25.
EIB-CM Action
The EIB-CM has performed an assessment of the complaint.
Conclusions
It appears that the complaint does not concern a concrete action and/or omission of the EIB, insofar as the contested section is not financed by the EIB. Moreover, the EIB-CM is not competent to investigate complaints concerning other International organizations, Community institutions and bodies, national, regional or local authorities. Therefore, the raised allegation falls outside the remit of the EIB-CM. As a result, the EIB-CM proceeds to close the case.
