Case Description

A complaint was lodged on 21 March 2018 on behalf of the affected people relating to a major water and sanitation project in Mongolia. The project comprised the financing of the water, wastewater and sanitation investment program in the Ger areas of the municipality of Ulaanbaatar (the Project).

The same complaint was sent to the Office of the Special Project Facilitator (OSPF) of the Asian Development Bank (ADB), a co-financier of the Project. The complaint alleged damages and negative impacts due to land acquisition and property valuation of the Project.

In view of the lead-financier status of the ADB in this project, it was decided between the EIB-CM and the OSPF in 2018, that the Accountability Mechanism of the ADB would take the lead in the handling of this complaint.

A series of round table discussions were conducted and culminated with the signing of a complaint resolution memorandum of understanding (MOU) on 2 July 2018. The MOU served as the guiding document for the case-by-case negotiations initiated in June 2018 and concluded on 14 September 2018, and agreement was reached with the affected complainants on land and asset value to be compensated.

The final stage in the resolution process was the completion for 15 non-title complainants to receive the Mayor’s ordinance and the corresponding land possession certificates. These agreed actions were completed on 21 October 2020 following which the OSPF published its Final Report. The EIB-CM consequently closed the case with a concluding letter to the complainants on 20/11/2020.
