EIB programme loan to finance investments of eligible mid-caps in the Benelux countries

This is an EIB programme loan to finance the investments of eligible mid-caps, with fewer than 3000 employees, from different sectors in Belgium, the Netherlands and Luxembourg.

Aspects environnementaux

The projects to be financed under this programme loan will most likely concern investments that are expected to be carried out in existing facilities without changing the already authorised scope and would therefore not require an environmental impact assessment (EIA) under Directive 2011/92/EU. However, for each sub-operation under this programme loan the Bank's services will review during the project appraisal whether any of the concerned projects could fall under the EIA Directive, as well as any other environmental legislation, and will ensure that those investments are implemented in compliance with EU legislation.

Passation des marchés

The promoters of the projects to be financed under this programme loan will be private companies not operating in the utilities sector and not having the status of a contracting entity, thus not subject to EU rules on public procurement. However, if after the appraisal of each project under this programme loan, the EIB were to conclude that the promoter is after all subject to EU public procurement legislation (i.e. Directive 2014/25/EU, or Directive 2004/17/EC where applicable), then the Bank would require the promoter to ensure that contracts for the implementation of the project will be tendered in accordance with the relevant applicable EU procurement legislation (i.e. Directive 2014/25/EU, or Directive 2004/17/EC where applicable, and Directive 92/13/EEC), as interpreted by the Court of Justice of the EU, with publication of tender notices in the Official Journal of the EU, as and where required.
